HOUSE OWNER & TENANT RIGHTS IN PAKISTAN (INCLUDING CANTONMENTS)
Tenancy law in Pakistan depends on the jurisdiction of the property.
i. In non-cantonment areas, tenancy is governed by provincial rent laws such as the Punjab Rented Premises Act, 2009 and the Islamabad Rent Restriction Ordinance, 2001.
ii. In cantonment areas, tenancy is governed exclusively by the Cantonments Rent Restriction Act, 1963.
Rights of Tenant
A tenant is entitled to peaceful possession, protection from forced eviction, due process of law and refund of security deposit subject to lawful deductions.
Rights of Landlord
A landlord is entitled to receive rent, recover arrears through legal proceedings and seek eviction only on lawful grounds through the competent forum.
Eviction Procedure
Eviction can only be carried out through the Rent Controller in non-cantonment areas or through the Controller under the Cantonments Rent Restriction Act, 1963. Self-help eviction is illegal.
