DIVORCE UNDER PAKISTANI LAW
Marriage is a legally recognized social institution in Pakistan. Where continuation of marriage becomes impossible, the law provides regulated mechanisms for dissolution to protect the rights of spouses and children.
Divorce is governed by Islamic principles as enforced through statutory law, primarily the Muslim Family Laws Ordinance, 1961 and the Family Courts Act, 1964.
Modes of Divorce
1. Divorce by Husband (Talaq)
A husband may pronounce Talaq. However, mere pronouncement does not dissolve the marriage.
i. Written notice must be sent to the Chairman Union Council with a copy to the wife.
ii. A statutory reconciliation period of ninety (90) days and Arbitration Council proceedings are mandatory.
iii. Divorce becomes effective only after completion of this procedure.
2. Divorce by Wife (Khula)
A wife may seek dissolution of marriage through Khula by filing a suit before the Family Court.
i. If reconciliation fails and the wife shows unwillingness to continue marital relations, the court may dissolve the marriage.
ii. Haq Mehr is payable to the wife unless lawfully waived. Maintenance during Iddat is obligatory upon the husband.
iii. The father remains responsible for maintenance of minor children irrespective of custody.
iv. Custody is determined solely on the welfare of the minor.
v. Dowry articles and gifts remain the exclusive property of the wife.
